(SAMPLE) CHOCOLATE FOUNTAIN SERVICES AGREEMENT

This agreement serves as a contract for one chocolate fountain service (Essentials/Complete) package, between Fountain FusionTM and _________________ (Client), for the event date and time specified below.

Fountain FusionTM agrees to furnish the following services to the Client:

- Fountain delivery to and from event (OPTIONAL travel charge)
- Setup and tear down of the chocolate fountain and dipping items
- (20/40) pounds of premium (milk/dark/white) chocolate
- Skewers and napkins
- Three hours of fountain operation with attendant
- OPTIONAL (Complete Package) - 5-8 dipping items per guest (list up to four different items) @ $x.xx/person
- OPTIONAL - Additional time booked at contract signing ($25 per half hour)
- OPTIONAL - Additional chocolate purchased at contract signing ($15 per two pounds)

Client agrees to furnish all items and services outlined in the PROVISIONS section of this contract.

OVERTIME FEES:
The Client may request extended use of the chocolate fountain the day of the event for a fee of $35 per half hour. Extended time booked prior to the event is only $25 per half hour. Payment for overtime is also due at the conclusion of the event.

PAYMENT TERMS:
Fountain Fusion has placed a temporary hold for the Client's event date and time. To change the hold to a reservation, the Client must return one signed and completed copy of this agreement, with a deposit of $150.00 (payable by check made out to Fountain Fusion), postmarked within 7 days after receiving this contract. If the signed contract is received after 7 days the reservation is subject to availability. The remaining balance is due at the conclusion of Client's event, payable by check.

All checks should be made payable to Fountain Fusion. A $45.00 fee will be assessed for all returned checks.

CANCELLATION POLICY:
Fountain Fusion TM will return the Client's deposit in the event of a cancellation initiated by the Client 14 or more days before the event. cancellations initiated by the Client within 14 days of the event data will result in the client's deposit being forfeited. If Fountain Fusion TM must initiate a cancellation at any time, due to an unforseen event not caused by the Client, Fountain Fusion TM will return the Client's deposit in full. The liability of Fountain Fusion TM to perform the services outlined in this contract are subject to cancellation due to sickness, accidents, acts of God, or any other influences not under our control.

PROVISIONS:
Fountain Fusion TM requires access to the desired set up area 1.5 hours prior to the scheduled event start time, and 1 hour after the conclusion of the event or our service time, whichever comes first. The Client is responsible for providing:

  • A sturdy, level table capable of supporting over 130 pounds, with enough room to reasonably and safely fit both fountain and dipping items (fountain diameter is 1.8 feet).
  • The event location must be either an indoor facility or a professionally constructed outdoor tent with at least three walls (to keep out wind and insects).
  • Close proximity (no more than 10 feet) to a 120 volt grounded electrical circuit capable of supplying at least 15 amps.
  • Client agrees to provide all table linens and have them set up prior to the fountain attendant's arrival. The fountain table cannot be moved once it has been assembled.

The Client accepts full responsibility and is liable for any and all damages, injuries, or delays that occur as a result of failure to comply with these provisions.

LIABILITY:
This agreement represents the only warranties, express or implied, between Fountain Fusion TM and the Client, including any implied warranty or merchantability or fitness for the particular purpose and for any other obligation or liability on the part of Fountain Fusion TM. Fountain Fusion TM shall not be liable for any injury, loss, or damage directly or consequently arising out of the use or inability to use the chocolate fountain.

The Client will indemnify Fountain Fusion TM against, and hold Fountain Fusion TM harmless from all claims, actions, proceedings, costs, damages, and liabilities, including attorney fees, arising out of, connected with, or resulting from misuse of the chocolate fountain by the Client and the Client's guests, or any individual that is able to gain access to the fountain during the event.

INSTRUCTIONS:
Keep a copy of this agreement for your records and return 1 signed copy, along with your deposit check made out to Fountain Fusion, to the address posted at the top of this agreement within 7 days of receipt to reserve chocolate fountain services for the event specified in this contract.
